01 Agreement to these Terms
These Terms of Service (the "Terms") form a binding agreement between you and SimpleMenu ("we," "us," or "our"), the operator of the SimpleMenu online ordering platform (the "Platform"). By creating an account, placing an order, installing or using our applications, or otherwise accessing the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, do not use the Platform. If you use the Platform on behalf of a business, you represent that you are authorized to accept these Terms for that business.
02 About SimpleMenu & definitions
SimpleMenu provides technology that lets restaurants and food businesses ("Restaurant Partners") offer their own branded online ordering to their customers. SimpleMenu is a technology provider; we are not a restaurant, food producer, or delivery company, and we do not prepare food.
- Platform means the SimpleMenu websites, ordering pages, dashboards, and applications.
- Apps means our Android mobile and tablet applications distributed through Google Play.
- Restaurant Partner means a business that uses SimpleMenu to take orders.
- Customer means a person who places an order through a Restaurant Partner's storefront.
- Order means a request for food or services placed through the Platform.
03 Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an Order. If you are under that age, you may use the Platform only with the involvement of a parent or legal guardian. By using the Platform, you represent that you meet these requirements and that the information you provide is accurate.
04 Accounts & security
Some features require an account. You agree to provide accurate, current information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use. We may suspend or close accounts that contain false information or that are used in violation of these Terms.
05 Signing in with Facebook
The Platform offers the option to register and sign in using Facebook Login, a service provided by Meta Platforms, Inc. ("Meta"). Using Facebook Login is optional; you may instead create an account with an email address and password.
What we access
When you choose to sign in with Facebook, you authorize SimpleMenu to receive certain information from your Facebook profile based on the permissions you approve — typically your name, email address, and profile picture. We request only the information needed to create and authenticate your account and to provide the Platform.
How we use it
We use information received through Facebook Login solely to identify you, create or access your account, and deliver the services described in these Terms, as further described in our Privacy Policy. We do not post to your Facebook account, message your contacts, or share your Facebook information with Restaurant Partners except as necessary to fulfill your Orders.
Our use of information obtained through Facebook Login complies with the Meta Platform Terms and Developer Policies. You can review or remove SimpleMenu's access at any time in your Facebook account under Settings & Privacy → Settings → Apps and Websites. Revoking access may prevent you from signing in with Facebook, but you can continue using the Platform with an email-based account.
Your use of Facebook is also governed by Meta's own terms and policies. SimpleMenu is not responsible for Meta's services.
06 Data deletion & revoking access
You may request deletion of the personal information associated with your account, including information obtained through Facebook Login, at any time.
- In Facebook: remove SimpleMenu under Settings & Privacy → Settings → Apps and Websites. This stops SimpleMenu from receiving further data from your Facebook account.
- From SimpleMenu: email [email protected] from the address on your account, or use the in-app account deletion option where available, and request deletion. We will delete or de-identify your personal information within the timeframe required by applicable law, except where we must retain certain records (for example, transaction history) to comply with legal obligations.
Data deletion instructions are also published at our Delete your account page for the purpose of the Meta app review process.
07 The apps & Google Play license
Subject to these Terms, SimpleMenu grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, solely for their intended purpose. You may not copy, modify, reverse engineer, decompile, sell, sublicense, or create derivative works from the Apps except where permitted by law.
Obtained through Google Play
If you obtain an App through the Google Play Store, your use is also subject to the Google Play Terms of Service and the Google Play Developer policies. You are responsible for any device, operating-system version, and network connectivity needed to use the Apps, and for any related charges. We may release updates and may require you to install them to keep using the Apps.
You acknowledge that these Terms are between you and SimpleMenu only, and not with Google. Google is not responsible for the Apps or their content. Google and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
08 Orders, prices & payment
Restaurant Partners set their own menus, prices, availability, taxes, service options, and policies. When you place an Order, the contract for the food or services is between you and the Restaurant Partner. SimpleMenu provides the ordering technology and, where offered, facilitates payment and delivery dispatch on the Restaurant Partner's behalf.
Payments are processed by third-party payment providers (which may include [Stripe, Xendit, GCash, Maya, or others]). By submitting payment information, you authorize the applicable provider and the Restaurant Partner to charge the total shown, including item prices, taxes, and any delivery or service fees. Cancellations, refunds, substitutions, and order accuracy are handled according to the relevant Restaurant Partner's policies and applicable law. Delivery, where offered, may be performed by the Restaurant Partner or a third-party delivery provider.
09 Restaurant partners
If you use SimpleMenu as a Restaurant Partner, you additionally agree that you are solely responsible for your menu content, pricing accuracy, food preparation and safety, labeling, tax collection and remittance, and compliance with all laws applicable to your business. You grant SimpleMenu a non-exclusive license to host, display, and reproduce your content and marks for the purpose of operating your storefront and promoting your Orders. You are responsible for fulfilling Orders you accept.
10 Acceptable use
You agree not to use the Platform to:
- break any law or regulation, or infringe anyone's rights;
- place fraudulent, false, or abusive Orders;
- upload viruses, malware, or harmful code, or attempt to disrupt or overload the Platform;
- access the Platform through automated means, scrape data, or probe for vulnerabilities without authorization;
- harass, threaten, or harm other users, Restaurant Partners, or our staff;
- impersonate any person or misrepresent your affiliation; or
- reverse engineer or attempt to gain unauthorized access to any part of the Platform.
We may investigate and take action, including suspension or removal, for any conduct we reasonably believe violates these Terms.
11 Your content
You retain ownership of content you submit, such as reviews, photos, or profile details. By submitting content, you grant SimpleMenu a worldwide, non-exclusive, royalty-free license to host, store, display, and use it as needed to operate and improve the Platform. You are responsible for your content and confirm you have the rights to share it. We may remove content that violates these Terms or applicable law.
12 Intellectual property
The Platform, including its software, design, text, graphics, and the SimpleMenu name and logo, is owned by SimpleMenu or its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not use our marks without our prior written permission.
13 Third-party services
The Platform integrates with third-party services, including login providers (such as Facebook), payment processors, delivery providers, and mapping services. Your use of those services is governed by their own terms and privacy policies. SimpleMenu is not responsible for third-party services or for any loss arising from your use of them.
14 Disclaimers
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. SimpleMenu does not warrant that the Platform will be uninterrupted, secure, or error-free. SimpleMenu does not prepare food and makes no warranty regarding the quality, safety, or accuracy of Orders, which are the responsibility of the Restaurant Partner.
15 Limitation of liability
To the fullest extent permitted by law, SimpleMenu and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform. SimpleMenu's total liability for any claim relating to the Platform will not exceed the greater of the amounts you paid to SimpleMenu in the three months before the event giving rise to the claim, or [USD 100]. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
16 Indemnification
You agree to indemnify and hold SimpleMenu harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms or of any law or third-party right.
17 Termination
You may stop using the Platform and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Platform. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
18 Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect means you accept the updated Terms.
19 Governing law & disputes
These Terms are governed by the laws of [Jurisdiction — e.g., the State of New York, USA], without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in [Venue], unless applicable law requires otherwise. Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your place of residence.
